📌Key Highlights & Summary:
  • •The Supreme Court published a 29-page full verdict on primary school teachers' seniority.
  • •Teachers directly recruited up to 2012 will retain seniority over nationalized teachers.
  • •Fifty percent of prior service for nationalized teachers will count as effective service.

The Supreme Court of Bangladesh has released the full 29-page verdict of its Appellate Division, granting the state's appeal regarding the seniority and promotion dispute involving nationalized primary school teachers. The verdict, delivered by a four-member bench led by the Chief Justice, was officially published on the Supreme Court's website. Legal experts and education department officials have noted that this comprehensive ruling effectively resolves long-standing complexities surrounding the appointment of head teachers across approximately 32,000 government primary schools nationwide.

According to the legal representatives of the Directorate of Primary Education, the apex court's ruling dictates that teachers who received direct appointments up to December 31, 2012, will maintain seniority over those whose institutions were nationalized in 2013. Conversely, teachers directly recruited from 2013 onward will rank junior to the teachers whose positions were nationalized on January 1, 2013. This determination is rooted in the provision that 50 percent of the prior service period accumulated by the nationalized teachers will be counted as effective service time for seniority calculations.

Furthermore, the Appellate Division clarified that for teachers nationalized from January 1, 2013, onwards, the 50 percent effective service rule will apply to their mutual seniority as well as their standing alongside directly recruited educators. Crucially, this recognized service period will also extend to their eligibility for future promotions, selection grades, and time-scale benefits. This administrative clarity is expected to bridge the gap between teachers recruited through different streams and harmonize promotional pathways within the primary education sector.

The legal framework governing the terms of service for teachers of private primary schools acquired under government orders dates back to September 2013, when specific service rules were formulated. Over the years, ambiguities within these rules spawned numerous legal battles in higher courts, delaying administrative decisions and halting headmaster appointments in thousands of institutions. With the publication of this full verdict, the government and educational authorities can now proceed with pending promotions and recruitment processes under a clear legal mandate.
